There is a lawsuit that has been filed by Jenna Marie Duncan the plaintiff who comes from Long Island in the state of New York. The defendant in this case is cold stone creamery which is the parent company for franchising. The cold stone creamery lawsuit alleges that cold stone creamery misled its customers by using the name pistachio for their ice cream products.
The plaintiff argues that despite cold stone creamery claiming that their ice cream contains pistachios, the ice cream did not contain any pistachios levels. In the lawsuit, the plaintiff argues that cold stone creamery does not contain any pistachios and only relies on artificial flavours.
This claim according to the cold stone creamery lawsuit is a direct violation of the New York Business law which regard to deceptive marketing. The plaintiff claims that cold stone claiming that their ice cream contains pistachios when in fact there was none in their drinks qualifies to be called deceptive marketing which must be punished by the law.
